BILL NUMBER: S7862 SPONSOR: BAILEY TITLE OF BILL: An act to amend the state finance law, in relation to excluding certain sums due from the definition of "debt" PURPOSE OF BILL: To remove the required twenty-two percent interest plus prejudgment interest that attaches to student debt when a student has defaulted on their student loan payments owed to the State University of New York. SUMMARY OF SPECIFIC PROVISIONS: This bill would amend the definition of "debt" as defined in the state finance law to exclude tuition, fees, room and board, student loans and all other related charges from the definition, thus removing the required twenty-two percent interest and prejudgment interest which must be collected by the Office of Attorney General when there is default.

BAILEY -- read twice and ordered printed, and when printed to be committed to the Committee on Finance AN ACT to amend the state finance law, in relation to excluding certain sums due from the definition of "debt" THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (b) of subdivision 1 of section 18 of the state finance law, as amended by section 1 of part C of chapter 81 of the laws of 2002, is amended to read as follows: (b) "debt" shall mean any liquidated sum due and owing any state agen- cy which has accrued pursuant to law or through contract, subrogation, tort or other cause of action, except FOR (I) A SUM DUE AND OWING ANY STATE AGENCY FOR A LIABILITY RESULTING FROM TUITION, FEES, ROOM AND BOARD, EDUCATIONAL BENEFIT OVERPAYMENTS, STUDENT LOANS, OR OTHER CHARGES INCURRED BY A STUDENT; OR (II) a liability resulting from taxes or other impositions administered by the state commissioner of taxation and finance, regardless of whether there is an outstanding judgment for that sum; § 2.
